The kidnapping of a baby at Monasterio de Piedra in Zaragoza case has finally been brought to court after an investigation that unsettled the family and mobilized a significant police force. More than three years after the events, the father, paternal grandfather, and a family friend are being tried as the main defendants in the case.
According to the indictment, this incident is described as a planned kidnapping within the family and includes allegations of previous threats, mistreatment, and an earlier attempt to kidnap the child. The prosecution is seeking significant prison sentences and various financial compensations for the physical injuries and emotional damages inflicted on the child and the mother.
Kidnapping Incident in the Monasterio de Piedra Parking Lot
The events under investigation took place on October 13, 2022, around 18:44, in the parking lot of Monasterio de Piedra in Nuévalos. The 28-year-old mother, originally from Ibiza and six months pregnant, was on a tourist visit with several relatives when she was stopped by her ex-husband, the baby's father, and the paternal grandfather.
When the baby was only 13 months old, both men allegedly approached with the intention of taking the baby without the mother's consent. The mother's resistance to handing over the child triggered a violent scene witnessed by other relatives and partially recorded on video.
According to allegations, the child's father attacked the mother from behind, causing both of them to fall to the ground. Meanwhile, the paternal grandfather grabbed the woman by the throat and hair, repeatedly hitting her head against the ground and did not stop despite the resistance shown by other relatives to protect the child.
The prosecution claims that during the struggle and pushing, the father forcefully pulled the baby by the arm, tearing him away from the car. At that moment, the father and grandfather kidnapped the child in a vehicle, and the kidnapping incident was resolved in less than 24 hours thanks to police intervention.
A Recorded Attack and the Family's Quick Response
A cousin of the mother raised the alarm by calling 112 SOS Aragón. Additionally, another relative managed to record part of the attack on a mobile phone, and this footage became crucial evidence to reconstruct what happened in the Monasterio de Piedra parking lot.
The baby sustained injuries and damage to his arm due to being forcibly separated from his mother, while the mother had to be treated at a health center due to feelings of suffocation. Three other relatives who attempted to prevent the kidnapping also faced slaps and pushes from the paternal grandfather.
From the very first moment, the Guardia Civil assessed the situation in the context of gender-based violence and domestic violence, as the mother had previous complaints about threats, coercion, and mistreatment. These complaints included threatening messages, tracking via mobile phone, and a previous attempt to kidnap the child in Ibiza.
Investigators expressed concern that the kidnapping might be linked to vicarious violence, meaning the child could be used to harm the mother. Therefore, a broad and coordinated search plan was immediately implemented among different security forces.
Escape with the Identified Vehicle and Discovery in Parla
After the kidnapping incident, the defendants left Monasterio de Piedra in a green Volkswagen Touareg, and the license plate and features were recorded thanks to the statements of relatives and obtained footage. This information was vital for tracking the vehicle through the Traffic General Directorate cameras.
The Guardia Civil, together with the National Police and units sent from Madrid, initiated a large-scale search plan. Traffic records, mobile phone locations, and video footage from the parking lot were used to track the father and grandfather.
Investigations led police to a house in the Parla district of Madrid, specifically on Monte Tabor street. There, less than <24 hours> after the kidnapping, the baby was found with his father and paternal grandfather, along with a family friend who provided logistical support for the escape according to investigations.
The baby was found in good condition and was immediately handed over to its mother. Later, all the defendants were arrested and referred to judicial authorities. The judge of the Calatayud First Instance Court issued a temporary imprisonment decision for the father and grandfather, while the third detainee was released as a necessary collaborator.
An Alleged Kidnapping Incident Planned with Family Support
The police investigation argues that the kidnapping was not entirely improvised; rather, it was a carefully prepared family plan. According to the Guardia Civil, the father and grandfather went to Zaragoza after learning through social media where the mother was with the baby.
Despite the difficulty of finding accommodation due to the festivals in Pilar, it is claimed that the defendants stayed in two different places before carrying out the kidnapping in the Monasterio de Piedra parking lot. Later, they attempted to avoid using main roads as they headed towards Madrid.
When they arrived in Parla, it is claimed that they had an infrastructure to remain hidden for a while: a house, a garage, an alternative vehicle, and a mobile phone purchased for matters related to the child. The third defendant, who is the owner of the apartment they sought refuge in, comes into play here.
This person is being prosecuted for concealment because the prosecution believes they provided an address, a phone number, and a vehicle to help the two main defendants escape justice and make it more difficult to find the child.
Investigators also pointed out other members of the paternal family. The child's grandmother was marked as a possible mastermind of the plan by covering the baby's care expenses and supporting a lawyer who informed the family, but no charges were made against her.
History of Violence and Previous Kidnapping Attempt in Ibiza
Beyond the kidnapping in Zaragoza, this case is evaluated in the context of increases in violence and conflict between the father and the child's mother. The woman has filed complaints due to threats, coercion, and mistreatment, stating that these behaviors created a constant atmosphere of fear and tension.
In this context, the mother recounted that the father sent her and her family threatening WhatsApp messages, attempted to geographically track her phone with a phishing message, followed her on a motorcycle through the streets of Ibiza on August 17, and just two days later attempted to kidnap the child in Ibiza.
Considering this context, the Guardia Civil believed that the situation could be an instance of vicarious violence. Therefore, in the words of the investigator in charge of the case, a decision was made to "put everything on the table" to rescue the child as soon as possible.
Following the investigation, the father was charged with membership in a criminal organization, kidnapping a minor, gender-based violence, and aggravated assault. The grandfather was charged with membership in a criminal organization, kidnapping a minor, and aggravated assault. The grandmother and a family friend face charges related to membership in a criminal organization and kidnapping a minor, but they are currently being tried only as three male defendants in this case.
Judicial Process and Requested Penalties
The preliminary hearing of the case is held at the Second Section Court, where evidence, the precise classification of events, and possible settlements are clarified. In this case, the father, paternal grandfather, and a friend accused of providing shelter after the kidnapping are being tried together.
The prosecution is seeking a seven-year prison sentence for the baby's father; this sentence is requested due to illegal detention and mistreatment charges, along with the kidnapping of a minor and membership in a criminal organization stemming from the investigation. This is the highest penalty requested in this process.
The prosecution's request for the paternal grandfather is five years in prison, which is sought due to his co-responsibility in the illegal detention of the child and physical assault against the mother. Additionally, an extra monetary fine is requested based on the degree of participation.
For the third defendant, the owner of the shelter in Parla, the prosecution is seeking a two-year prison sentence; this relates to the concealment charge for allegedly providing an address, a vehicle, and a phone to help the main defendants escape justice.
The police intervention ensured the child's rescue within <24 hours>; this is a situation that the prosecution emphasized as a key element to guarantee the child's physical and emotional integrity. However, according to the prosecution, the short duration of the abduction does not lessen the penal weight of depriving a child of their freedom and violently separating them from their surroundings.
Compensations and Liabilities Arising from the Abduction Incident
In addition to prison sentences, the case also includes the financial liability section; here, various compensations are being claimed for the mother, child, and other relatives affected by the abduction and the attack in Monasterio de Piedra.
The prosecution is demanding that the father and grandfather pay the mother 684 euros in compensation; this amount is related to the injuries and damages suffered. Additionally, the father must pay another 555 euros for the wounds he sustained on his arm while forcibly separating from the child's mother.
The paternal grandfather is also obliged to pay 259 euros in compensation for the injuries he sustained while trying to prevent the child's abduction. Although these amounts may seem modest compared to the perceived seriousness of the events, they aim to legally recognize the physical and moral damage by adding to the prison sentences. The final decision will depend on the evaluation of evidence during the trial.
With the lawsuit filed, this baby abduction incident that took place in Monasterio de Piedra was resolved within <24 hours>, but it left a deep mark on the family and will be subject to the scrutiny of justice. The process will seek to clarify how organized the plan was, the role of each defendant, and whether this incident represents a turning point in a story filled with violence for the mother and child.
